Please read these Terms of Service ("Terms") carefully before using the Botanic Base mobile application ("App"). These Terms govern your access to and use of the App and constitute a legally binding agreement between you and Botanic Base ("we", "us", "our"). By downloading, installing, or using the App, you agree to be bound by these Terms.

Eligibility

You must be at least 13 years of age to use the App. By using the App, you represent and warrant that you meet this age requirement.

License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable license to download, install, and use the App on your personal device solely for your personal, non-commercial use.

Restrictions

You agree not to:

  • Copy, reproduce, distribute, or create derivative works of the App.
  • Modify, reverse-engineer, decompile, or disassemble the App, or attempt to derive its source code.
  • Remove, alter, or obscure any copyright, trademark, or other proprietary rights notices displayed in the App.
  • Use the App for any illegal purpose, or in violation of any applicable laws or regulations.
  • Use the App in any manner that could interfere with, disrupt, or negatively affect the performance or functionality of the App or any third-party services.

Intellectual Property

All content, including but not limited to, text, graphics, logos, icons, and images, available in the App, is the property of Botanic Base or its licensors and is protected by copyright and other intellectual property laws. Your use of the App does not grant you any rights to use any trademarks, logos, or service marks contained within the App.

Third-Party Services

The App uses the Yelp API to provide information about plant stores near your location. Your use of the App and any information you receive through the Yelp API is subject to Yelp's Terms of Service and Privacy Policy. We are not responsible for the content, accuracy, or reliability of any information provided by third-party services, and you use such information at your own risk.

Termination

We reserve the right to terminate or suspend your access to the App, without prior notice or liability, for any reason or no reason, including, without limitation, if you breach these Terms. Upon termination, your right to use the App will immediately cease.

Disclaimer of Warranties

The App is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, secure, or free of viruses or other harmful components. Your use of the App is at your sole risk.

Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Botanic Base, its affiliates, directors, employees, or licensors be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to, loss of profits, data, use, or goodwill, arising out of or in connection with your use of the App, even if we have been advised of the possibility of such damages.

Governing Law

These Terms shall be governed and construed in accordance with the laws of the jurisdiction in which Botanic Base is located, without regard to its conflict of law provisions.

Changes

We reserve the right to modify or update these Terms at any time, and you agree to be bound by the revised Terms by continuing to use the App. If we make any material changes to these Terms, we will notify you by posting a notice in the App or by sending you an email to the email address you provided.
